Ebay Powerseller and Canada Revenue Agency Update

Recently, I posted an article on the status of the Canada Revenue Agency’s request for customer information regarding Canadian PowerSellers during the years 2004 and 2005 The Federal Court of Canada ordered ebay to hand over the data they have for 2004/2005. As you know ebay wants to protect its members’ privacy, eBay is continuing to contest the requirements for 2004 and 2005. Of course, it goes without saying that all Canadians should abide by Canadian tax laws and all other relevant regulations. eBay Canada is currently appealing the court ruling that would force eBay Canada to release the information of all Canadian Ebay Powersellers.

Despite that appeal being still underway, eBay was ordered by the Federal Court of Canada to release the information immediately. eBay strenuously objected to this order, and announced that they would launch a second appeal and this time it would be going to the Supreme Court of Canada. To avoid being forced to release our members the information before the first appeal has been decided.

eBay was pleased to report that they have since reached an understanding with the Canada Revenue Agency (CRA) such that they no longer need to turn over the PowerSeller records for the years 2004 and 2005 until the original appeal has been heard. As a result, the planned appeal to the Supreme Court of Canada is no longer necessary.

    OK this is a real dumb move Canada’s CRA is trying to do.

    I own a small home recording studio. It is a hobby studio and I make no money from it. Almost all the gear I have bought has been out of stores. (Full Price New Gear) Several thousand dollars of gear,
    So now if a want to sell some of my gear, off Ebay or other, I’m going to have to pay taxes ?
    Tell me how does that work ?

    Is Canada real moving into the direction of some form of socialist country ? I’m really questioning now if it is ??
    This CRA’ move is going to destroy Canada’s economy.

    If I bought a baseball card off of Ebay for $1000 and sold it for $500, would I still have to pay tax on that even though I lost money? If the answer is yes, it doesn’t make sense.
